纽约州对英特尔提起反垄断诉讼

　　在一项持续了近两年的调查之后，美国纽约州司法部长安德鲁•库默(Andrew Cuomo)昨日指控称，全球最大的芯片制造商英特尔(Intel)利用“行贿与胁迫”的手段，来维持自身市场主导地位。
　　New York's attorney general yesterday alleged that Intel, the world's biggest chipmaker, had used “bribery and coercion” to maintain its dominant market position after an investigation lasting nearly two years.

　　英特尔已经在接受美国联邦贸易委员会(Federal Trade Commission)的调查，并且受到了欧洲、日本和韩国类似机构的严厉谴责。
　　Intel is already under investigation by the Federal Trade Commission and has been censured by the FTC's counterparts in Europe, Japan and Korea.

　　但库默向联邦法院提出的诉讼是迄今为止最为详细的指控。
　　But Andrew Cuomo's action, filed in a federal court, is the most detailed to date.

　　库默在一份陈述文件中指称：“英特尔利用行贿和胁迫的手段来维持其对市场的控制，而不是进行公平竞争。”
　　“Rather than compete fairly, Intel used bribery and coercion to maintain a stranglehold on the market,” the attorney general alleged in a statement.

　　“英特尔的行为不仅不公地限制了潜在竞争者的发展，而且还损害了普通消费者的利益，剥夺了他们享受更好产品和更低价格的权利。我们必须制止这些非法手段，并使这个至关重要的市场恢复竞争。”
　　“Intel's actions not only unfairly restricted potential competitors, but also hurt average consumers who were robbed of better products and lower prices. These illegal tactics must stop and competition must be restored to this vital marketplace.”

　　该诉讼指控英特尔为了让个人电脑制造商只使用自己生产的微处理器，向它们支付了数十亿美元，其中包括2006年给戴尔(Dell)的20亿美元“回扣”。该诉讼文件表示，英特尔还对与其竞争对手AMD公司(Advanced Micro Devices)合作过于密切的个人电脑制造商进行威胁与惩罚。
　　The lawsuit alleges that Intel paid billions of dollars to PC makers for their exclusive use of its microprocessors, including $2bn in “rebates” to Dell in 2006. It says Intel also threatened and punished PC makers working too closely with its competitor, Advanced Micro Devices (AMD).

　　威胁手段包括削减以回扣形式支付给个人电脑制造商的好处、资助该制造商的竞争对手、终止合资企业。
　　Threats included cutting off payments in the form of rebates to PC makers, funding a competitor and ending joint ventures.

　　One internal Dell e-mail said Intel was “prepared for jihad if Dell joins the AMD exodus”.

　　We [will] get ZERO [rebates] for at least one quarter while Intel ‘investigates the details' – there's no legal/moral/threatening means for us to apply and avoid this.”

　　库默的诉讼要求英特尔支付金钱赔偿，并结束反竞争行为。英特尔已经表示将应诉。
　　Mr Cuomo's suit seeks monetary damages and an end to anti-competitive acts. Intel said that it would defend the suit.
